A Privacy Policy is a legal document that explains how a party gathers, uses, discloses, and manages a client's data — and how the personal data of that client is protected. This Privacy Policy ("Policy") governs the manner in which www.eTaxcart.com uses and discloses information collected from its users (each, a "User"). It is published pursuant to Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which requires the publication of rules, regulations, privacy policy, and terms of use governing access to and usage of eTaxcart.com.

Information You Provide During Transactions

If a User chooses to purchase any product or service from the Company, the User permits the Company to gather personal information necessary to process the transaction.

User-Generated Content

The User is aware that any information provided through messages, reviews, feedback, or any other content posted on the Website may be used by the Company to assist the User in any reasonable way in future. Such retained information may be used to resolve disputes, provide customer support, troubleshoot problems, and for similar service-related purposes. Where required, such information may also be provided to judicial or governmental authorities of competent jurisdiction, or otherwise used by the Company as permitted by applicable law.

Any communication received about a User's activities or postings on the Website (including from third parties) may be compiled by the Company into a file or folder maintained internally. The User acknowledges this practice.

Browsing Without Providing Information

A User may browse the Website without providing any personal information. However, for certain activities — such as placing an order, registering for an account, or availing a service — the User will need to provide the necessary information. The User acknowledges that the information so provided may be used by the Company to send the User offers and promotions, whether or not based on the User's previous orders or interests, and the User hereby expressly consents to receive the same.

Optional Surveys

The Company may, from time to time, request the User to complete optional online surveys. These surveys may ask for contact information and demographic information (such as PIN code, age, income bracket, and gender). The data so collected is used to customise the Website for the User's benefit, to provide products, services, and content of likely interest, and to display content according to the User's preferences. The User is aware of this practice.

The Company may request the User to provide reviews for products or services purchased or availed. The User acknowledges that such reviews help other Users make informed decisions and help the Company maintain the quality of its offerings. The User hereby expressly authorises the Company to publish any review written by the User on the Website, along with the User's name and certain contact details, for the benefit of other Users.

Removal of Content

Content, reviews, surveys, or feedback submitted by the User may be stored, uploaded, published, or displayed by the Company at its discretion. The User authorises the Company to remove any such content from the Website, with or without cause and without being required to notify the User of the same.

04Sharing of Personal Information

The Company may share the User's personal information in the following limited circumstances:

Fraud Prevention & Corporate Affiliates

Personal information may be shared to detect and prevent identity theft, fraud, and other illegal acts. It may also be shared with corporate affiliates of the Company to correlate related or multiple accounts (to prevent abuse of the Website's services), and to facilitate joint or co-branded services where such services are offered by more than one corporate entity. The User acknowledges this.

Legal & Regulatory Disclosure

The Company has the right to disclose the User's personal information if required to do so by law, or if the Company believes that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal processes. Personal information may also be disclosed to law-enforcement officers, third-party rights owners, or other third parties if the Company believes such disclosure is reasonably necessary to enforce the Terms or this Policy; to respond to claims that any advertisement, posting, or other content violates the rights of a third party; or to protect the rights, property, or personal safety of its users or the general public.

Business Transfers

In the event that the Company is involved in a merger, reorganisation, amalgamation, restructuring, or sale of business, the Company may share the User's personal information with the relevant entity or successor. Any such recipient will continue to be bound by the Terms and this Policy, as may be amended from time to time.

The Company does not sell, lease, or rent your personal information to any third party for their independent marketing purposes.

05Payment & Transaction Data

All transactions made on the Website are secure and protected. Information shared during a transaction is encrypted to protect the User against unintentional disclosure to third parties.

The Company does not receive, store, or retain the User's full credit-card or debit-card details in any manner. Payment information is provided by the User directly to an authorised payment-gateway partner that is compliant with the regulations and requirements of the banks, financial institutions, and card networks with which it is associated.

The Company may retain limited transaction records (such as order ID, amount, date, and reference number) for accounting, audit, and statutory record-keeping purposes.

The Website may also contain cookies or similar data-collection devices installed by third parties or affiliates. The User acknowledges that the Company does not control the use of such cookies or devices by third parties, and the User assumes any and all risks in this regard.

Your Choice

You can choose to accept or decline cookies. Most browsers automatically accept cookies, but you can usually modify your browser settings to decline them. Please note that declining cookies may prevent you from taking full advantage of certain features on the Website.

You may opt out of marketing communications at any time by clicking "unsubscribe" in any such email or by contacting us directly. Opting out of marketing does not affect transactional communications related to your active services.

How We Contact You

From time to time, we may also use your information to contact you for market-research purposes. We may contact you by email, phone, or messaging — and we may use the information to customise the Website according to your interests.

We will not sell, distribute, or lease your personal information to third parties unless we have your permission or are required to do so by law.

10Data Retention

We retain your personal information only for as long as is necessary to fulfil the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, audit, or reporting requirements.

  • Tax-related records: retained for the minimum period required by Indian tax law (currently up to 8 financial years from the end of the relevant assessment year).

This includes — but is not limited to — the User's consent to the Company sharing or disclosing the User's information in the limited circumstances set out in Section 4 above.

12Limitation of Liability

While we take all reasonable steps to safeguard your information, you acknowledge that no method of electronic transmission or storage is 100% secure. 13Dispute Resolution & Jurisdiction

Any dispute relating to the formation, interpretation, or performance of this Policy shall be resolved through a two-step Alternate Dispute Resolution ("ADR") mechanism. The Parties further agree that the contents of this Section shall survive the termination or expiry of this Policy and/or the Terms.

Step 1 — Mediation

If a dispute arises between the Parties, they shall first attempt to resolve it amongst themselves through good-faith mediation, to the mutual satisfaction of both Parties. If the Parties are unable to resolve the dispute within thirty (30) days of one Party notifying the other of the existence of a dispute, the matter shall be referred to arbitration.

Step 2 — Arbitration

The order passed by the sole arbitrator shall be valid and binding on both Parties. The costs of arbitration shall be borne by the Parties as directed by the sole arbitrator, who may in his/her sole discretion direct either Party to bear the entire cost of the proceedings.
